| Summary: | La caducidad del proceso, instituto que sanciona con el archivo del expediente los asuntos que se paralizan por causas atribuibles a la parte actora, no fue regulada en el Código Procesal Contencioso Administrativo, toda vez que, se consideró que serían suficientes las facultades que este cuerpo de normas otorgaba al juzgador, para evitar la inmovilización de los procesos. Empero, la realidad es otra, y estas potestades no bastaron para paliar todos los supuestos presentados -prevenciones sin cumplir-, por lo que, se existen causas detenidas indefinidamente. Ello evidencia falta de interés y las medidas que se están aplicando por la autoridad judicial generan problemáticas -incertidumbre e inseguridad jurídica-, en lugar de solucionar las disyuntivas.
